> Zoning Board ofAppeals Meeting Minutes May 13, 2026 RESOLVED: That after careful examination of the site and evaluation of the information submitted with the application, the Board determined that such application, the construction of minor accessory structures (such as driveways, fences or pools) is a Type II action pursuant to 6 NYCRR 617.5(c) (12); and no further environmental review is required pursuant to said regulations; and WHEREAS: The property is located in the A-1 (1 acre) zoning district, listed in the Assessor’s records as 1.31 acres and on the submitted lot coverage form as 57,141 sq. ft. (quadrilateral); and WHEREAS: The property being improved with a home; and WHEREAS: Chapter 310-88 of the Village Code authorizes the Board of Appeals to consider Special Use Permits for the construction of swimming pools; and WHEREAS: The plans depict the location of the swimming pool, swimming pool equipment, fencing, sport court and landscape screening; and WHEREAS: The project appears to meet the lot coverage requirements; and WHEREAS: The location of the swimming pool and swimming pool equipment appear to meet the Village Code required setbacks; and WHEREAS: The Board members are familiar with the site and the materials in the application; now therefore be it RESOLVED: That the application of 189 Heathcote LLC, Case #11 of 2026, for a Special Use Permit, pursuant to Chapter 310-88 of the Village Code, to construct a swimming pool and sport court at 189 Heathcote Road, as shown on the Drawing SW-1 titled “Grading Plan” dated Sept. 28, 2024 and last revised 2/28/25, Drawing CM-01 Sheet 1 of 2 titled “Property Masterplan Front” last revised 10.22.2025, Drawing CM-01 Sheet 2 of 2 titled “Property Masterplan Rear” last revised 10.22.2025, Drawing CD-01 Sheet 1 of 1 titled “Pool Code Gate and Fence” undated, Drawing CM-01 Sheet 2 of 2 titled “Rear Yard Fence & Gate Plan” last revised 10.22.2025 and all related submission materials be approved based on the following findings and conditions:
